That statement is accurate. Sandra Day O'Conner is still a sitting Associate
Justice. She worded her retirement so that it does not take effect until her
successor is confirmed. It's Rehnquist's death that reduces the number of
justices from 9 to 8.

Good news for you, Jay, just announced Bush is nominating John Roberts to
Chief Justice spot. Ain't that the way, a brother man works hard for 15
years on the job only to see The Man promote a white man just off the
streets ahead of him. Nobody knows the trouble Thomas sees. Nobody knows his
